What is Stamp Duty?

Stamp duty is a tax levied by the state government on the transfer of property ownership. In Maharashtra, stamp duty is paid on the registered value of the property (the higher of the agreement value or the ready reckoner rate fixed by the government). Stamp duty is a major additional cost that every property buyer must account for, over and above the flat price.

Stamp Duty Rates in Maharashtra (2025)

For residential properties in Maharashtra (including Virar, Nalasopara, and Vasai which fall under the Vasai-Virar City Municipal Corporation area), the stamp duty rates as applicable are:

  • Male buyer: 6% of the property value
  • Female buyer (sole owner): 5% of the property value (1% concession)
  • Joint purchase (male + female): 6% (no concession applicable)
  • Mumbai city and Mumbai suburban districts: An additional metro cess of 1% is applicable. Vasai-Virar area does NOT fall under the Mumbai or Mumbai Suburban district and is part of the Palghar district, so the metro cess of 1% does not apply to properties in Virar, Nalasopara, and Vasai.

Property Registration Charges in Maharashtra (2025)

In addition to stamp duty, buyers must pay property registration charges to the Sub-Registrar's office. In Maharashtra:

  • Registration charge: 1% of the property value
  • Maximum cap: ₹30,000 (registration charges are capped at ₹30,000 for any property, regardless of value)

For most flats in Virar and Nalasopara priced up to ₹30 lakhs, the 1% registration charge is less than the ₹30,000 cap. For properties above ₹30 lakhs, you pay a flat ₹30,000 in registration charges.

GST on Under-Construction Properties

If you are buying an under-construction flat (one that does not yet have an Occupation Certificate), GST is applicable in addition to stamp duty and registration charges:

  • Affordable housing (carpet area ≤60 sq m in metro cities / ≤90 sq m in non-metro, price ≤₹45 lakhs): 1% GST (without ITC)
  • Other residential properties: 5% GST (without ITC)

GST is NOT applicable on the purchase of a ready-to-move-in flat (one with an Occupation Certificate).

Total Cost Calculation Example

Let's calculate the total cost for buying a 2 BHK flat in Virar at an agreement value of ₹55 lakhs (under construction, male buyer):

  • Flat base price: ₹55,00,000
  • GST at 5%: ₹2,75,000
  • Stamp duty at 6%: ₹3,30,000
  • Registration charges (capped): ₹30,000
  • Total outgo: ₹61,35,000 (approximately 11.5% more than the base price)

This example is for illustration only. The actual stamp duty is calculated on the registered value (agreement value or ready reckoner value, whichever is higher). Your advocate will calculate the exact stamp duty payable.

Ready Reckoner Rates (Annual Statement of Rates)

The Maharashtra government publishes Annual Statement of Rates (ASR), commonly called the ready reckoner rates, for all areas. These rates are revised annually and represent the minimum value at which stamp duty is calculated. If your agreement value is lower than the ready reckoner rate, stamp duty will be calculated on the ready reckoner rate.

Other Charges to Budget For

  • Legal/advocate fees: ₹10,000 – ₹25,000 for drafting and review of sale agreement
  • Home loan processing fee: 0.25% – 1% of loan amount (varies by lender)
  • Property insurance: Optional but recommended; typically ₹3,000 – ₹8,000 per year
  • Maintenance deposit: 12–24 months advance maintenance charged by most builders
  • Corpus fund: Some builders charge a one-time corpus fund deposit for long-term maintenance

Summary

As a thumb rule, budget an additional 10–12% over the flat price to cover all taxes, duties, registration, and charges. This is a significant amount that many first-time buyers underestimate. Always ask the builder for a detailed all-inclusive cost sheet before committing to a purchase.
